The BIPA test settlement got preliminary approval for the settlement fund of $18,224,000. The settlement administrator has started accepting the claim form from the class members till the deadline, 20 June 2025.
Class members who wish to exclude themselves from the BIPA test settlement can submit the exclusion or objection form before 05 June 2025. The settlement involves the defendant, NCS Pearson, Inc., violating the Biometric Information Privacy Act (BIPA) as they use facial comparison and palm scan technology for administrative purposes without the written consent.
The Illinois BIPA restricts companies from obtaining, storing, or transferring the biometric information or identifying information of any individual without presenting a written disclosure and consent. The defendant denies the BIPA violation but proposes to compensate the class members.

Who can claim?
According to the BIPA test settlement involving NCS Pearson, Inc., people who meet the following eligibility conditions will be class members, and they can file their claim for the cash payment:
- If you had your palm scanned for the administration examination in the state of Illinois at the Pearson test center during the class period, 31 January 2017, and 25 October 2023, and did not provide the authorization to the Pearson VUE Biometric Data policy, which is in effect from 01 Feb 2023, or
- If you participated in the remotely proctored test through Pearson’s OnVUE testing system, which may have included facial comparison from any location within Illinois from 15 August 2019 till 01 February 2023.
Settlement Payout Amount
The NCS Pearson, Inc. has agreed to pay $18,224,000 in the settlement fund to compensate the class members, however, the fund will first be used to pay for the expenses, like 38% of fund will go to attorney fees & costs, administration notice expenses & costs, and class representatives’ service rewards up to $10,000 to $6000.
The court will approve the above expenses & costs, and after the amount is deducted, the administrator will use the remaining funds to provide cash payments to the class members who have filed a valid claim before the deadline. Currently, the administrator has not revealed the payout per claimant in the settlement because it depends on many factors.
The payout for each claimant would depend on the number of claims filed, remaining funds, and other variables that may determine the payout. The class members can expect equal payment based on the administration examination they have taken.
How to claim?
The BIPA test settlement class members who wish to file the claim form to receive the cash payment can submit it in the following ways:
- Online: Class members of the settlement can follow the steps below to file for the compensation online on the settlement website:
- On the Settlement Website, go to the Submit a Claim option and read the instructions carefully, and ensure you have the Unique ID that you received via postcard notice or email.
- Next, click the “Start your Claim” option and enter your Unique ID, contact information, and other info.
- Next, click the Submit button, and that’s it, your BIPA test settlement claim form is filed.
- Once you submit the claim, you will receive the confirmation code via your email, confirming you have successfully submitted the BIPA test claim form.
- By Mail: You can also mail the claim form to the settlement administrator following postal address, if you can’t send online or you do not have a Unique ID:

Class members who fail to submit the claim form or do not take any action, either by submitting the claim form online or excluding themselves, cannot receive the cash payment from the administrator.
When to expect?
The BIPA test settlement class members can expect the payout only after the federal court grants the final approval to the settlement, which is scheduled to be held on 08 July 2025. If the federal court grants approval for the settlement, the claimants can expect the payment to follow up in a month or two.
However, if someone appeals against the BIPA test class action court judgment, the administrator has to stop the payment distribution or any process related to the settlement until the appeal is denied or resolved by the court.
