Enzo Data Settlement 2025: Eligibility Criteria, Expected Payout, and How to Claim?

The Enzo Biochem Data Security lawsuit has reached the proposed settlement stage; the court has granted preliminary approval for the settlement fund of $7.5 million. Under the court’s authorization, the settlement administrator released the claim form for the class members.

The US residents who meet the class member criteria can submit their claim form before 23 June 2025, and the class members who wish to exclude themselves or object to the settlement should submit the respective form before 23 May 2025. 

The Enzo data lawsuit is related to the Ransomware attack on Enzo Biochem, Enzo Clinical Labs happened on or about 06 April 2023, which affected the personal information of the individuals or former patients of Enzo. Though the defendant denied the allegations, they agreed to settle the lawsuit with a settlement fund.

Who is eligible?

The US residents who meet the following eligibility criteria of the Enzo data settlement will be the class members, and they can claim compensation:

  • All the people living in the United States who were affected by the Network incident in April 2023 may have their personal information compromised, and have received a notice from Enzo Biochem about the potential personal information breach.  
  • The settlement administrator also released the notice via mail about the settlement to the potential class members.  

Exception:

  • The judges or judicial staff related to the Enzo Biochem data lawsuit and their immediate family members are excluded from the settlement.
  • The subsidiaries, parent companies, affiliated companies, officers, employees, or directors of Enzo Biochem will be excluded.
  • The successor of any natural person or the assigned person is excluded from the settlement. 

Settlement Payout

According to the Enzo Biochem data settlement agreement, the $7.5 million fund will first be used to cover the administrative expenses, taxes related to the settlement, service awards, and attorney fees & costs before the fund is used to compensate the class members. 

Under the Enzo data settlement, the class members can get the following benefits based on the claim they made:

  • Payment for Document Loss: Class members who have lost the documents may get reimbursement for the losses up to $10,000, if they present the proper documented evidence. 
  • Cash Fund: The class members who don’t have evidence of document loss can apply for the cash payments, as well as people who applied for document loss. The cash payout is not determined yet as it depends on the net settlement fund, the number of claimants, CMIS claims, and other factors.

Apart from monetary benefits, the class members can also get credit monitoring and insurance services for their healthcare data for two years under the settlement benefit. So, if you choose any of the above settlement benefits, you can also choose the CMIS two-year coverage through a premium. 

How to claim?

The Enzo data settlement class members who wish to submit the claim form online can follow the following steps:

  •  You should visit the Enzo Data settlement website mentioned above.
  • Next, click the Submit claim option on the right and enter your notice ID and confirmation code mentioned in the notice. 
  • Once you submit the code and notice ID, the settlement claim form will open on your screen.
  • Next, fill in the claim form with the valid details and upload the documents (if applicable) on the portal. 
  • Once you have entered all the details and attached documents, submit the claim form after reviewing the entered information. 

The class members who can’t apply online can also submit the claim offline through mail after they download the form from the website or request a paper claim form through mail or by calling 1-877-447-4103 and post the filled claim form at the following postal address:

When to expect?

The Enzo Biochem data settlement final hearing for the court approval is scheduled on 10 June 2025 at 11 AM, in which the court will decide on the fairness of the settlement. If the court grants approval of the Enzo data settlement, the class members with valid claims can expect the payout within 90 to 180 days of the settlement, if no one appeals against the court decision. 

If someone appeals the court decision, all Enzo data settlement processing will stop until the appeal is resolved, so the payout date will be unpredictable. The settlement administrator updates information about the settlement payment distribution on the official website, hence, the class members are advised to check the website regularly.
