Settlement Payout
Under the Rite Aid data settlement, the class members can receive the settlement payout based on the settlement benefit they select when they file the claim. According to the settlement agreement, the administrator will first use the settlement fund to cover the following expenses:
- Attorney’s Fee and costs up to 35% of the settlement fund;
- Class Counsel cost and expenses
- Administrative costs and applicable taxes
- Service awards (up to $3,500 for each class representatives)
Once the above expenses and costs are deducted from the $6.8 million settlement fund, the remaining fund will be used to compensate the class members with valid claims. The class members can receive the compensation through any one of the following settlement benefits:
- Documented loss payment: The class members who have supported documents for the loss they faced due to the Rite Aid data breach can claim this benefit and get a chance to receive compensation up to $10,000 per person. The loss should be related to the data breach, like money lost in dealing with the data breach through bank statements, invoices, etc.
- Cash Fund Payment: If you have no documentation, you can opt for the cash fund payment, where the administrator will send the payment to the class members based on proportionate allocation, hence, we can’t determine the payout per person for now, though every class member will receive the payout fairly.
