The USAA data breach class action settlement final approval hearing date is scheduled on 21 May 2025. The New York Southern District Court gave preliminary approval for the USAA data breach settlement in December 2024 and authorized the payment selection form.

Payout Amount
The USAA does not agree with any wrongdoing in the class action, but they have agreed to pay $3.25 million to compensate the affected class members whose personal information was affected. The class member who has filed the payment selection form before 07 April 2025 and did not file the exclusion or objection form, can expect an equal portion of payment from the fund.
Before the administrator compensates the class members, the administrator will use the fund for paying administration notices costs, service rewards up to $10,000, attorney fees & costs up to $1.08 million, and other expenses approved by the federal court. When the above-mentioned expenses are deducted from the settlement fund, the rest of the fund will be used to compensate the class members.
The payout per person is hard to determine as it depends on the net settlement fund, the number of class members, and other factors. According to the administrator’s estimate, around 22,600 individuals are eligible for the compensation, and they will all equally receive the payout.
Who will receive it?
According to the federal court, people living in the United States are the class members of the settlement when they meet the following conditions:
- The US individuals whose personal information was compromised, stolen, or accessed by a third party due to the Data breach identified on or around 06 May 2021.
Exception:
- The USAA platform officers, directors, successors, subsidiaries, legal representatives, assigns, and controlling interest of the USAA are not included in the settlement.
- The data breach settlement judicial officer, judge, justice, or judicial staff, and their immediate family members, are ineligible for the payout.
- The class members who have filed the objection or exclusion form for the settlement before 07 April 2025 would be excluded from the settlement payout.
When to expect?
The USAA data breach settlement final hearing was set on May 21, 2025, where the court will review the reasonableness of the settlement payout for the class members. The final court hearing will be held in the New York Southern District Court courtroom 620.
Generally, if the court approves the settlement, the class members can expect the payment in 180 days. However, it may take time of a year to allocate and distribute the payment depending on the process. The class member can expect a delay in the payout if someone appeals the court decision after the approval.
The appeal against the court decision on the settlement can stop the processing until the appeal is finalized and the court disagrees with the appeal. So, if there is no appeal, the class members can expect the payout by the end of 2025.
